The statutory procedure is accompanied by a code of practice on unions' access to the workplace during recognition and derecognition ballots and a draft method of conducting collective bargaining, to which the CAC is required to have regard in responding to requests to impose a legally binding procedure.
This section gives the Secretary of State powers to introduce regulations to prohibit the compilation, dissemination and use of lists recording individuals' trade union membership and activities. The prohibition is limited to lists, which are compiled with a view to being used to discriminate against the named trade unionists in recruitment or in employment. There will be public consultation on regulations to be made under the power later this year.
